Refund Coming???

I got an email from a real law firm today, CC'd to the AG's office, and apparently my refund really is coming! If I lived closer (I live in Canada), I might not take the money just for the fun of going to court someday but right now I think I'll just take the money. Nothing was mentioned about taking my blog down once I get a check...

"This firm represents BHM Golf in its suit with the Illinois Attorney General's office and we are endeavoring to make restitution to any individuals who are owed funds or merchandise by BHM Golf. Your complaint and restitution amount of $173.00 are not being disputed by BHM Golf with the IL Attorney General's office, and any communications you may have previously received from BHM Golf were meant to be attempts to try and make up for the delay in processing your refund by offering you merchandise of greater value than the amount you are currently owed, and to reach you so that your complaint could be settled without further delay. I sincerely apologize if any previous communications were misleading as to that respect. BHM is completely willing to send you a check for the amount owed you at this time if you agree that, upon receipt of your refund check and its clearing in your bank account, you will acknowledge the receipt of funds and agree to have your complaint deemed resolved, by email or other written or verbal communication to the IL Attorney General's office."

You might want to contact the IL Attorney General's office if you are owed amounts by Brian? Not sure if it is too late to join in on the legal action.

AG Ilinois Suing Brian H. Meyer!!!!!

"Attorney General Lisa Madigan filed a lawsuit today against a DuPage County online sporting goods retailer who faces a range of allegations including the failure to provide consumers with purchased products. The suit, filed in DuPage County Circuit Court, names Brian H. Meyer, doing business as BHM Golf of Villa Park, as the defendant."

"Madigan's lawsuit alleges that Meyer violated the Illinois Consumer Fraud and Deceptive Business Practices Act and asks the court to prohibit Meyer from engaging in the business of selling sporting goods over the Internet and from further violating Illinois' consumer protection laws. The lawsuit seeks restitution to consumers and court costs."

"In addition, Madigan's suit seeks a civil penalty of $50,000 and additional penalties of $50,000 for each violation found to have been committed by Meyer with the intent to defraud."

My stuff is in the mail to the AG Illinois Consumer Protection Division but I am calling the 1-800 # to see if I can somehow get added, not sure if this is a class action, but it does mention restitution for consumers and I hope to be included!

Paypal

I did contact PayPal and made an official complaint about BHM and their business practices. The rep seemed interested, but who knows if the complaint went any further...

Ecco Shoes

I didn't order Ecco shoes, but Brian sells them. And for some reason he sent me an email from Ecco customer service about another problem he is having (this is around when I contacted some manufacturers, and then Tiger Shark contacted Brian and he got royally pissed). Customer was sent wrong size and colour of shoes, sent them back, Ecco issued BHM refund, BHM did not issue customer refund. Customer contacts Ecco.

Ecco customer serivce then contacted their rep who was to deal with Brian. So please contact Ecco customer service if you are having troubles with an Ecco order and add to the complaints. They at least have acknowledged complaints before.

Illinois Attorney General

Since I finished exams and have some time off school I finally got my package ready to send to the Illinois AG: Consumer Fraud Bureau. They asked for all documents so it is maybe 50 pages of email, credit card statements, phone records, invoice...At this point I think me dealing directly with Brian is futile as his bag of excuses is infinite.

"refund" going to paypal...I didn't order through paypal

So....Brian says my refund is going to paypal. i called tonight and he was rather apologetic. Well, ostensibly.

I didn't order through paypal! I checked my record for the past year, plus transaction shows up on my credit card as BHM, not paypal (which it would if I had ordered paypal). So perhaps he is trying to get me into the paypal scam.

This is after he twice stated in email "I have refunded your credit card." I emailed him today asking where the refund is and now he says he cannot refund via credit card because it is too late...and then he is convinced I ordered through paypal...Asked him why I have to email him to find out this info, a regular merchant would contact the customer.

Credit card won't do anything, it is too late now.

I am calling paypal, just to file a complaint about Brian in general and double confirm that there is no transaction.

Refund Coming?

So the clubs were returned to Villa Park from Oregon.

Since I've been playing hardball, Brian is trying to be "nice". He has offered me a further discount on the clubs. Would I pay $95 for the clubs, and he will refund my original bill? No thanks. I don't want to be sending more money!

It took about 5 emails before he understood that I wanted a refund and I did not want the clubs from him under any circumstances. Again, he insisted that I speak to him over the phone. I refused, insisted again on a refund and said he would not change my mind whatever he said.

No refund yet. Wouldn't be suprised if he says he is mailing a cheque to Oregon.

Calling at 11:30 pm?

What retailer calls a customer at 11:30 pm? I was doing homework late tonight, and BHM called (or so says my call display--didn't feel like a chat with Brian right before bed). Good chance I, or someone in my household, could have been sleeping. He probably didn't know the time difference between my home and Chicago, but it was 12:30 am in Chicago!

Return to Sender

So after I told Brian he couldn't reroute orders to Canada because there was no information for customs with the parcel, he tries, fails, and now the package (1lb--for clubs?) is going back to BHM HQ in Villa Park.

Now I am insisting on the refund since the package is going back, thinking of sending the registered mail letter, and filing a complaint with the Internet Crime Center (no point in waiting until he screws up again?).
